Welcome to Wheezi. These Terms of Service (“Terms”) govern your access to and use of the Wheezi smart inhaler accessory (“Device”), the companion mobile application (“App”), and our website and services (“Services”). By using any part of the Wheezi ecosystem, you agree to these Terms in full.
1. Acceptance of Terms
By using our App, Device, or Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, you may not use Wheezi.
2. Eligibility
– You must be at least 13 years old to use the App.
– If you are under 18, you must have permission from a parent or legal guardian.
– You must use the App and Device only for lawful and intended purposes.
3. Product Disclaimer
– Wheezi is a consumer wellness accessory, not a medical device.
– It is not intended to diagnose, treat, cure, or prevent any medical condition.
– The information provided through the App is for informational purposes only and does not replace professional medical advice.
– Use of Wheezi is at your own risk.
4. License to Use
We grant you a limited, non-exclusive, non-transferable license to use:
– The Wheezi Device with its intended features
– The Wheezi mobile App downloaded through official app stores
– Any software or firmware provided with the Device
You may not:
– Copy, modify, reverse-engineer, or distribute any part of the App or firmware
– Use the Services for any illegal, harmful, or abusive activities
– Use Wheezi in any way that violates these Terms or applicable laws
5. Subscriptions and Payments
Access to full features of the App may require a paid subscription.
a. Billing Terms
– Subscriptions are billed in advance on a recurring basis (monthly or annually) depending on your selection
– Payments are processed through the Apple App Store or Google Play and subject to their billing rules
b. Renewals
– Subscriptions auto-renew unless canceled at least 24 hours before the end of the billing period
c. Cancellations
– You can cancel your subscription anytime in your device’s app store account settings
– Canceling prevents future charges but does not refund current or past periods
d. Refunds
– All refund requests must be made through Apple or Google. Wheezi does not issue direct refunds unless required by law
e. Changes
– We may adjust subscription pricing or features with prior notice. Continued use after changes implies acceptance
6. User Accounts (if enabled)
If account creation is introduced:
– You agree to provide accurate, current information
– You are responsible for safeguarding your login credentials
– We may suspend or terminate your account for violating these Terms
7. Location Tracking & Responsible Use
Certain features of the App (e.g., “Find My Cap” or “Last Seen”) rely on optional location services.
By enabling these features, you agree to:
– Use location tracking only for personal use with your own Wheezi device
– Not use Wheezi to track, monitor, or stalk another individual
– Not attach the Wheezi device to someone else’s belongings without their knowledge and consent
Wheezi LLC is not responsible for the misuse or abuse of its tracking features. Misuse may result in account termination and could be reported to law enforcement.
8. Updates & Modifications
– We may update the App, firmware, or Terms at any time
– We will notify users of material changes where legally required
– Continued use of the App or Device after changes constitutes acceptance
9. Limitations of Liability
To the fullest extent permitted by law:
– Wheezi is not liable for any indirect, incidental, or consequential damages
– We do not guarantee uninterrupted or error-free operation
– You agree that use of the App and Device is entirely at your own risk
10. Warranties
– The Wheezi Device may include a limited warranty (see Warranty Policy for details)
– We disclaim all other warranties, express or implied, to the maximum extent allowed by law
11. Intellectual Property
– All software, branding, logos, and designs associated with Wheezi are owned by Wheezi LLC
– You may not reproduce, distribute, or use our intellectual property without written permission
12. Termination
– We reserve the right to suspend or terminate access to the App or Services for any violation of these Terms
– Upon termination, your license to use Wheezi Services will immediately end
13. Governing Law
These Terms are governed by and interpreted in accordance with the laws of the State of Wyoming, United States, without regard to conflict of law principles.
